Terms of Service

1.Your account

• You must be at least 18 years old and use devhelp shop for business purposes.
• You must give accurate information and keep it up to date.
• Keep your sign-in details secure. You are responsible for activity in your account, including what your team members do.
• Tell us at admin@devhelp.pk straight away if you think someone has accessed your account without permission.

2.Early access

devhelp shop is currently offered through early access. We may accept or decline applications, limit the number of stores, and add, change or remove features while the service develops. We will tell you about changes that affect how you use the service.

3.Your store and your responsibilities

You are the seller in every sale made through your store. devhelp provides the technology, and the contract for each sale is between you and your shopper. You are responsible for:

• Your products, prices, descriptions and images, and making sure they are accurate and lawful.
• Delivering orders, handling cancellations, returns and refunds, and looking after your shoppers.
• Publishing clear prices, delivery terms and return policies, and meeting the consumer protection, tax and other laws that apply to your business, including the Punjab Consumer Protection Act 2005 or the equivalent law where you operate.
• Collecting and using shoppers’ information lawfully and keeping it confidential.
• Any taxes due on your sales.

Before your store goes live, we review it. We may ask for changes, or decline to launch a store that does not meet these terms.

4.Acceptable use

You must not use devhelp shop to sell, promote or take part in any of the following:

• Anything illegal in Pakistan or where you or your shoppers are, including content that is unlawful under the Prevention of Electronic Crimes Act 2016.
• Weapons, ammunition or explosives; narcotics or controlled substances; prescription medicines without the required authorisation.
• Counterfeit, stolen or infringing goods, or content you do not have the rights to use.
• Gambling, pyramid or get-rich-quick schemes, or sexually explicit material.
• Content that promotes violence, hatred or terrorism, or that harasses others.
• Fraud, phishing, deceptive offers or misleading claims about products.
• Malware, spam, or attempts to break, overload, scrape or get around the security or limits of the service.
• Custom code that harms shoppers, collects their information without notice or interferes with checkout.

We may remove content, pause custom code or suspend a store that breaks these rules, and we may report illegal activity to the authorities.

5.Fees and payment

• Plan fees are in Pakistani rupees. They are shown on our pricing page or when you subscribe, and are charged monthly or yearly in advance.
• Fees do not include taxes. We add sales tax on services, or any other levy that applies, where the law requires it.
• devhelp does not charge a commission on your orders. Payment providers and couriers charge their own fees, on their terms.
• If a payment fails, we will let you know. If fees are still unpaid 14 days after they were due, we may pause checkout on your store. If they stay unpaid after that, we may suspend the account.
• We will give you at least 30 days’ notice before changing the price of your plan.
• Fees already paid are not refundable, except where the law requires a refund or we agree otherwise in writing.

6.Payments, couriers and other services

Card payments are processed by payment providers such as Safepay under your own agreement with them, and the money is paid into your own account. devhelp does not hold the money from your sales. Cash on delivery is collected by the courier you choose.

Payment providers, couriers, domain registrars and other services you connect are provided by third parties under their own terms. We are not responsible for their services, fees or decisions, such as approving an application or releasing a payment.

7.Managed services

If you hire devhelp for managed services, we will agree the scope, fees and duration with you in writing. These terms apply to that work unless the written agreement says otherwise.

8.Your content and data

You keep ownership of your store content and data. You give devhelp a non-exclusive, royalty-free licence to host, copy, process, adapt (for example resize images) and display that content only as needed to run your store and provide the service.

You can export your store’s data from the dashboard at any time. If your account is closed, you can ask us for an export within 30 days. After that we may delete or anonymise your data, except where we need to keep it under the law or our Privacy Policy.

9.devhelp’s property

devhelp shop, including its software, templates, designs and brand, belongs to devhelp or our licensors. You may use the templates to build and run stores on devhelp. You may not copy, resell or reverse-engineer the service. If you send us feedback or ideas, we may use them without owing you anything.

10.Domains

If you connect a domain to your store, you must own or control it and keep its registration and DNS settings in order. Your domain is registered with your registrar and is governed by the registrar’s rules.

11.Availability and support

We aim to keep devhelp shop running, but it may sometimes be unavailable during maintenance or updates, or for reasons outside our control. Support is available by email at admin@devhelp.pk.

12.Closing your account, suspension and termination

You can close your account at any time by contacting us at admin@devhelp.pk.

We may suspend or close an account or store if you break these terms, do not pay fees, create legal or security risk, or harm shoppers, other merchants or devhelp. Where reasonable we will give notice and a chance to fix the problem first. Parts of these terms that are meant to last, such as fees owed, ownership, disclaimers, limits on liability and governing law, still apply after an account is closed or terminated.

13.Disclaimers

devhelp shop is provided “as is” and “as available”. To the extent the law allows, we do not promise that the service will be uninterrupted or error-free, or that it will meet every requirement of your business, and we are not responsible for the products you sell or the actions of shoppers, couriers or payment providers.

14.Limits on liability

To the extent the law allows, devhelp is not liable for indirect or consequential losses, such as lost profits, lost sales, lost data or damage to reputation.

Our total liability for all claims relating to devhelp shop is limited to whichever is higher: the fees you paid us in the 12 months before the claim, or Rs 10,000.

Nothing in these terms limits liability that cannot be limited by law.

15.Indemnity

You will compensate devhelp for claims, losses and costs that arise from your products, your store content or your dealings with shoppers, or from your breaking these terms or the law.

16.Changes to these terms

We may update these terms. We will change the date at the top, and tell merchants about significant changes by email or in the dashboard at least 14 days before they take effect. If you keep using devhelp shop after that, the updated terms apply.

17.Governing law and disputes

These terms are governed by the laws of Pakistan. If you have a dispute with us, please email admin@devhelp.pk first so we can try to resolve it. If it is not resolved within 30 days, the courts at Lahore, Punjab have exclusive jurisdiction.

18.General

• You agree to receive notices and keep records electronically. Under the Electronic Transactions Ordinance 2002, accepting these terms online is as binding as signing them.
• We may send notices to the email address on your account or show them in the dashboard.
• If any part of these terms cannot be enforced, the rest stays in effect. If we do not enforce a term straight away, we have not given up the right to enforce it.
• You may not transfer your account without our consent. We may transfer these terms as part of a reorganisation, merger or sale.
• Neither of us is responsible for delays caused by events beyond reasonable control.
• These terms, together with the Privacy Policy and any written agreement for managed services, are the whole agreement between you and devhelp about devhelp shop.

19.If you are shopping at a store on devhelp

Stores on devhelp are run by independent merchants. When you buy from one, your purchase is from that merchant, and the merchant is responsible for the products, delivery, returns and refunds. Please contact the store first about an order. If you think a store is breaking the law or these terms, email us at admin@devhelp.pk.
